§1. General provisions

  1. Definitions:

    8. Account: It is the Site database entry that enables the identification of the User or Professionals with the help of a username and password, thus allowing them to access certain services.
    9. Service: The service provided in the electronic environment is based on the process of data exchange through public information processing and telecommunication systems in line with the request of the recipient (User). During these transactions, the parties do not need to be present at the same time.
  2. The Service Provider provides the Services in accordance with this Terms of Use.
  3. The Terms of Use are binding for the User without the need to sign any additional contract.

§2. Types and Scopes of Services

  1. Service Provider provides the following Services:
    1. To ensure that users, Professionals and Organizations publish their information cataloged according to provinces, cities and categories and the satisfaction evaluations of patients,
    2. Making the search engine accessible to Professionals and Organizations,
    3. To make notifications about new information and satisfaction evaluations,
    4. Provide Professionals with the ability to enter and edit information about them as well as to respond to Users’ evaluations,
    5. To enable Professionals and Organizations who want to take advantage of the appointment opportunity by using the appointment software and call center offered by the Site, to make their appointment procedures.
  2. The Service Provider reserves the right to make any of the services provided under the Site paid, and is obliged to notify possible changes one month in advance.

§3. Terms of Service Providing

  1. The conditions that must be met in order to benefit from the services are as follows:
    1. Having access to the internet network,
    2. Having an e-mail account,
    3. Have one of the following internet browsers: Firefox, Chrome, Safari, IE, Opera updated to the latest version
  2. Information and opinions about Professionals and Organizations are available to everyone and anyone can use the search engine.
  3. In addition to these, logged in Professionals can:
    1. You can report satisfaction evaluation about Professionals and Organizations,
    2. Add or edit information about Professionals and Organizations,
    3. They can activate the service of sending notices about new information and opinions.
  4. The login process is possible after User registration. To login, the username (e-mail address) and password specified during registration is entered.
  5. The Service Provider reserves the right to temporarily suspend the provision of the Services during the modernization of the Site or the maintenance work to be carried out on the data processing and telecommunication systems.
  6. The Service Provider cannot be held responsible for any malfunctions in the provision of the Services for reasons beyond its control.
  7. The Service Provider cannot be held responsible to the Professional or the Organization for the user’s failure to attend the appointment. The Service Provider cannot be held liable to the User for not being able to receive healthcare services due to professional or institutional reasons. In the event of a situation that prevents the appointment from being made, the parties are obliged to cancel the appointment from their profiles and inform the other party of the situation via telephone, e-mail or SMS message. The service provider is only obliged to make available the software that allows making appointments.

§4. Adding Views and Information About Professionals and Organizations

  1. Comments (patient satisfaction reviews) are signed by the User with a signature (nick) specified during registration.
  2. The opinions and information about the professionals can only be related to the professional life of the professional and the satisfaction of the patient with the service received.
  3. The opinions and information about Professionals and Organizations can only be based on the User’s personal experience. They cannot be based on the rumors of third parties. The exceptions to this rule are parents or guardians who treat their children, relatives who are mentally unstable (or in some way disabled to share their opinions on the platform subject to the Convention) or elderly people in need of care, and animal owners who treat their animals.
  4. A User is not allowed to provide more than one opinion on the same medical procedure (examination, analysis, medical procedure, etc.).
  5. It is strictly forbidden to publish content that is partially or completely covered by the relevant legislation, advertising, and similar activity or other prohibitions or that aim to advertise or promote any third person or institution.
  6. Information, opinions and comments cannot be against the laws and social life rules.   7. The user acknowledges and undertakes that he is personally and exclusively responsible for the accuracy of the information he adds or whether it violates the rights of third parties.
  8. The Service Provider has the right to refuse to publish opinions and information that violate the Terms of Use or the law and to delete those that have already been posted.
  9. The Service Provider cannot be held responsible for the content of the information, opinions and comments entered by the Users or Professionals.
  10. The Professional is strictly prohibited from manipulating his or other users’ comments or other variables and / or commenting on his profile.
  11. Users cannot make false accusations in their profiles or in the profiles of others.

§5. Profiles of Professionals, Confirmed Profiles

  1. In order to create a profile of a new Professional, at least basic information about that Professional must be entered.
  2. Basic information about the professional includes: Professional title, name, surname, city, city where he / she serves, category of the professional, and also the address and contact information of the place where the patient is admitted, if any.
  3. Each professional has only one Profile. Several Professionals are not allowed to open a common profile. Duplicate Profiles will be deleted.
  4. In the fields where name and surname must be entered, information other than the name and surname of a single Professional cannot be entered. The following information is not allowed to be entered in these fields: Name of company, practice or healthcare institution.
  5. Each Professional can create or confirm their own Profile. Registration is required for this purpose.
  6. The Profile created or confirmed by the professional will be marked as “Confirmed profile”.
  7. The Professional with the Confirmed Profile has additional powers. This Professional may perform the following operations to comply with the remaining terms and include but are not limited to:
    1. Edit information about him,
    2. You can add your photo,
    3. You can add informative videos about professional practices,
    4. Can respond to comments entered by users,
    5. You can view the statistics of visits.
  8. The professional can add a photo of himself that only allows him to be recognized. At the same time, the personal information he has placed on the Site is publicly published and gives the right to the Service Provider to use and process, reproduce, disseminate, representate, and transfer them. The professional agrees and declares that he/she will provide a non-exclusive, continuous and gratuitous intellectual property right license with transmission rights. Deleting the account will not change this situation either. It is forbidden to post photos belonging to others or other non-photographic graphics. Considering the characteristics of digital photos, retouching is allowed on these photos. However, these retouches should only be intended to improve the overall quality of the photo (eg color, contrast). It is not allowed to remove or add some elements from the photographs, to combine more than one photograph or to change the original composition of the photograph. Posting of pornographic photos or photos that do not conform to the professional nature of the Site is prohibited.
  9. Photos that do not meet the above conditions can be deleted by the Service Provider without any warning or notification to the Professional.
  10. The Service Provider has the right to refuse publication of information that is found to be incorrect and to delete what has already been posted.

§6. Organization Profiles, Confirmed Profiles

  1. Basic information about the organization includes: Name, category, province, city, address and contact information of the health institution.
  2. To create a new Organization Profile, at least basic information about that Organization must be entered.
  3. Each organization has only one Profile. It is not allowed to open a common Profile for more than one Organization. Duplicate Profiles will be deleted.
  4. Organization Profile can only be related to an organization at one address. If the health unit has more than one branch, a separate profile can be opened for each branch.
  5. Each Owner can create or confirm their Organization Profile. Registration is required for this purpose.
  6. Profile created or confirmed by the owner will be marked as “Confirmed Profile”.
  7. The Owner has additional powers in the Confirmed Organization Profile. This Owner may perform the following, but not limited to, to comply with the remaining terms:
    1. You can edit information about the organization,
    2. You can add the logo of the organization,
    3. Can respond to comments entered by users,
    4. You can view the statistics of visits.
  8. The owner can only add the logo of the institution he is the manager of. It also allows the logo that he placed on the Site to be published publicly. It is forbidden to post photos that are not suitable for the site.
  9. Logos that do not meet the above conditions can be deleted by the Service Provider without any warning or notification to the Manager.
  10. The Service Provider has the right to refuse publication of information that is found to be incorrect and to delete what has already been posted.

§7. Conditions Regarding Conclusion and Termination of Service Delivery Contracts

  1. The contract is made by making an appointment using the appointment calendar software, registering on the Site and activating the Account.
  2. By performing this transaction, the User who registered an account accepts the provisions of this Terms of Use and undertakes to abide by these provisions.
  3. If the User ceases to accept any provision in the Terms of Use, he is obliged to delete his Account immediately or to notify the Service Provider of this situation.

  5. The Service Provider will allow Users and Professionals to access, correct and supplement their information. The Service Provider does not make the information accessible to third parties without the permission of the User or the Professional. Requests by official authorities with appropriate powers are not included.
  6. During registration, diploma registration number and Identity Number must be entered in addition to the information required for user registration. Employees who work without special authorization should send copies of their diplomas and identity cards, which they will receive with a scanner, showing that they have the necessary training. The registration numbers and document copies entered will only be used to confirm that the Professional has the necessary authorizations.
  7. Any User or Professional who can prove that they are authorized to manage the Organization Profile can achieve Owner status.
  8. In the event of doubts about the accuracy of the information entered by the user, the Service Provider may request appropriate documents confirming the accuracy of this information.
  9. When the registration on the site is made, the processing of the personal information of the User and the Professional on the registration form and the information published in the Profiles created by them is allowed.
  10. By registering on the site and performing Account activation, the User, Professional or Owner;
    1. Declaring that he has read and accepted the entire content of the Terms of Use,
    2. Agree to the processing of personal information and to publish Professional information in the Profile in accordance with the provisions of this Terms of Use,
    3. Stating that the information entered in the registration form is correct,
    4. He/She accepts receiving system messages, messages about malfunctions in the operation of the Site, notifications about changes in the Terms of Use, information about new functions and commercial information to the e-mail address specified in the registration form.
    5. He/she accepts to receive an appointment confirmation, reminder, promotional and informative sms, e-mail, phone call and all kinds of electronic messages.
  11. It is not allowed to open more than one Account.
  12. Opening the account to third parties is prohibited.
  13. It is forbidden to use third party accounts.
  14. A message with a link will be sent to the email address provided by the User and the Professional. If this link is opened, the account is activated and it is possible to log in.
  15. The contract is made indefinitely.
  16. The User, Professional or Owner can terminate the contract by deleting their account. Deleting the Professional’s or Organization’s account will not result in their Profile being deleted.
  17. Each of the parties may terminate the service provision agreement electronically, without giving any reason and without warning.
  18. The Service Provider reserves the right to terminate the contract by deleting the account if the actions of the User or the Professional are in violation of the law and the Terms of Use or damage the reputation of the Site.
  19. The Service Provider reserves the right to make changes in the services, tools and the way the Site works, to delete all the information in the databases, to terminate its activities, to transfer the Site rights and to perform all kinds of transactions regarding the Site in accordance with the law. The User cannot claim any compensation from the Service Provider regarding the specified transactions.

§8. Responsibility

  1. Service provider does not take any responsibility for the content and structure of the information and materials posted on the Site by the User or the Professional. The user acknowledges and undertakes that he is personally and exclusively responsible for the accuracy of the information he adds or whether it violates the rights of third parties.
  2. The User or Professional is fully responsible for the damages and illegal actions that may arise from their actions on the Site. These actions include, but are not limited to, providing inaccurate information, disclosure of professional secrets or other secrets, violation of personal rights or copyright or similar rights, and a prohibition of advertising / advertising.
  3. The Service Provider clearly states that the risks that may arise from the use of the Site and the use of the Services provided belong only to the User or the Professional.   8. The Service Provider does not take any responsibility for the accuracy of the documents such as diploma, certificate of expertise sent by the Professional during registration to the site. The User and the Professional accept and undertake that they are personally and exclusively responsible for the accuracy of the documents they add or whether they violate the rights of third parties.

§9. Complaint Notification Method and Objection / Return Procedure

  1. The Service Provider will use all reasonable efforts to ensure the correct functioning of the Site and will provide support in resolving problems related to the operation of the Site.
  2. Complaints about the reliability of the comments made on the site are sent using the “Report Complaint” button next to the opinion.
  3. Other warnings, complaints, suggestions and errors found at the bottom of each page can be transmitted using Communication link.
  4. Replies to complaints will be sent to the User’s or Professional’s e-mail address as soon as possible.
  5. These complaints are processed within 14 days of being sent. If this is not possible within this period, the Service Provider will inform the reason for this delay and the new time before this period expires.
  6. The Service Provider reserves the right not to process this complaint if the complaint has arisen due to the unknown knowledge of this Terms of Use, the annexes of the Terms of Use or the provisions of the law.
  7. Submission of compensation claims to the courts is possible only if the Complaint / Objection / Return procedure is inconclusive.

§10. Consultancy Platform and Fee

  1. Appointments are made through the appointment form available to the user on the site.
  2. Appointments can be made online or as a clinic appointment.
  3. For appointments made online, an e-mail with the appointment information will be sent to the user and the professional.
  4. When it is time to meet with online appointments, the professional starts the conversation by clicking the “start the conversation” button in the e-mail sent to him/her. The user joins the conversation by clicking the “join the conversation” button in the e-mail sent to him/her.
  5. Online interviews will be made through the Zoom application.
  6. The professional must have a Zoom account in order to start the conversation. The user is not required to have a Zoom account, but must have the Zoom application installed on their device.
  7. The professional must share the Zoom API Key and API Secret information in order to make online calls while registering on the site.
  8. The price of the appointment made by the user is determined by the Professional. The professional can change the consultancy fee as they wish.
  9. The user will pay the appointment fee by credit card.
  10. Paid appointments can be canceled up to 24 hours before the appointment time. In this case, the entire fee will be refunded to the user.
  11. No refund will be made in case of cancellation of appointments set for the same day.
  12. The fee determined by the professional during registration on the site is paid to his/her account on the 15th of each month with the amount invoiced by the Professional. .
  13. The Professional must bill the Service Provider by filling out the Invoice file sent to him during registration. The information to be used when billing is as follows:

  14. The service fee specified by the professional during registration on the site will be paid to him/her. The fee indicated on the consulthealthspecialists.com page is the amount + the service fee added by consulthealthspecialists.com to the fee specified by the professional.

§10. Final Provisions

  1. The Service Provider has the right to unilaterally change the Terms of Use. Before such a change, Users and Professionals will be notified of these changes by a notification to the e-mail addresses provided during registration.
  2. The User and the Professional are not authorized to access, in case they give an incorrect or someone else’s e-mail address, especially He is responsible for not reaching the notification specified in the 1st article.
  3. Relationships between the parties are regulated by Canadian law.
  4. The relevant legislation provisions are binding in matters not regulated by the Terms of Use.
  5. The courts where the Headquarters of the Service Provider is located are authorized to resolve disputes regarding the Services provided.
  6. This Terms of Use overrides the provisions of the previous Terms of Use and enters into force on the day it is published on the Site.
